Terms of Service

1. Authorisation

1.1. Parents and guardians authorise their child’s/children’s involvement in Learners Academy Pty Ltd Programs – Study Champs Tutoring, Logical Coders,  Memory Abacus Lab and Lotus Yoga Kids.

1.2. Parents and guardians authorise their child/children to participate in centre-based activities organised for the days my child/children will be attending.

Privacy

2.1. Parents and guardians understand that Learners Academy Pty Ltd collects information regarding the family for the purpose of registering the children into the education provided. The information will be used for administration purposes and to contact you in the event of an emergency, or purpose directly related to Learners Academy. It will not be disclosed to any other party except as required by law in compliance with the Privacy Act 2002.

3. Copyright

3.1. Learners Academy resources, books and learning materials are provided by Learning Academy exclusively for the purposes of Learning Academy providing education services to its students. Learners Academy resources, books and learning materials cannot be reproduced, sold, gifted, published or otherwise used for any other purpose.

3.2. All material in Learners Academy LMS (online resources) are copyrighted to Learners Academy and cannot be reproduced, sold, gifted, published or otherwise used for any other purpose.

4. Payment of Enrolment and Tuition Fees

4.1. Enrolment fees of $50 per child must be paid at the time of enrolling your child in any of the Learners Academy Pty Ltd Programs. Enrolment fees is non-refundable.

  1. Student will be automatically re-enrolled in next term until and unless parents and guardians inform in writing and request for cancellation of enrolment.
  2. Students returning after 2 or more terms have to enrol again and pay the enrolment fees again.

4.2. Tuition fees as specified from time to time must be paid one term in advance, as due dates in invoice or ONE WEEK before the start of the term and payments are governed by as follows:

  1. ALL payments must be made in FULL and ON TIME in order to ensure books and other learning materials are provided on time and to obtain any special offers or discounts made available by Learners Academy. Existing Students are required to pay the full term’s fees at re-enrolment. If due to any financial difficulty, you would like to make payments by instalments you will need to contact us to make arrangements.
  2. A late fee of $5.00 for administration costs may be charged to students who do not pay their fees within the first week from the beginning of each term. If you are issued with a Fee Payment Reminder Letter from Learners Academy, your fees will be defined as being late, and this fee will apply also. Every additional Reminder Letter will also incur additional Late Fee costs.
  3. Learners Academy has the right to issue legal and debt recovery action against parents or guardians who have not paid overdue fees as requested. Parents and guardians will risk Learners Academy listing their overdue fees with Credit Rating Australia, and have credit rating and history negatively and adversely affected.

4.3. All payments are non-refundable. No fee refunds or credit adjustments will be made for change of mind or missed lessons. If the Student is absent, they can attend a make-up lesson as stated below.

4.4. Learners Academy reserves the right to change the fees anytime.

4.5. Trial Classes

Try Study Champs classes for one week with no obligation! You can join our classes for one week, and if you don’t think this is for you, you can walk away for free. However, if your child is happy to continue with us then you will be required to pay for the invoice in the full amount – which is inclusive of the first one week.

5. Missed Lessons

5.1. Make-up lessons are available only for these programs – Study Champs Tutoring and Memory Abacus Lab. Due to the nature of the program no make-up lessons are provided for Logical Coders and Lotus Yoga Kids program.

5.2. If the Student is absent, they can attend a make-up lesson during an alternative day or session time.

5.3. Prior booking of make-up lessons is essential and is subject to availability.

5.4. Not more than two make-up lessons will be provided in any term. Must be made up during the current term and is only offered if fees are up to date.

6. Drop offs and Pick ups

6.1. Students can be dropped off only 10 minutes before the class. Any early drop off than this will not be supervised. Parents and guardians should ensure that their child is picked up on the nominated time by them. For any delay in pick-ups beyond 10 minutes, there will be a fine of $10 for every 10 minutes.

6.2. Parents and guardians have to wait outside the classroom while drop-offs and pick-ups. To ensure that class is not disturbed no parents and guardians are allowed inside the classroom.

7. Homework and Progress – Study Champs Tutoring and Memory Abacus Lab Programs

7.1. Learners Academy believes that no child is same and child education is a collective effort from parents, school and tutors. It is expected from parents to contribute towards achieving their child educational goal. Each week students receive homework which needs to be completed by the following class session. Completion of homework tasks is essential and parental support is expected.

7.2. Learners Academy will only correct and/or mark homework if any such homework is returned to Learners Academy for that purpose – it is the parent’s responsibility to make sure the Student does any homework and submits it to Learners Academy for marking or correction. It is not the responsibility of Learners Academy to make any follow-up or to ensure that the Student makes any attempt to do or completes any homework. Learners Academy provide a homework/tuition and correction service. Learners Academy do not provide a parenting service or child care. Learners Academy do not wish to lecture students about homework or impose it on them. Learners Academy will provide homework but won’t enforce attempt or completion of any such homework – ensuring attempt and/or completion of any homework is the responsibility of the Student and the parents.

7.3. The classes are not conducted on one-to-one basis. The classes are held in small groups. All our teachers work hard to mark the homework as per the given timeframe. If inadvertently something is not marked or marked incorrectly, it will be rechecked.

7.4. Every term, class tests will be held to help teachers write progress reports more accurately. Parents will receive detailed test results and individual reports at the end of the term. No personal phone calls will be entertained by teachers and tutors regarding child homework or progress. Book an appointment with the teacher in advance to discuss the progress of your child/children. The progress of child will be discussed only after term tests are taken. Please don’t call teacher after every class to discuss the progress. If required, teacher may discuss the progress of any student during term before the tests.

7.5. If Learners Academy books and learning materials are lost or missing, parents and guardians must request a replacement which will be at the sole discretion of the management of Learners Academy. A fee will be applied if the replacement is issued.

7.6. A student who has enrolled for a term course in Study Champs Tutoring program will receive an invitation to join the course on the Learners Academy LMS (online resources). A student will continue to access the LMS (online resources) they have enrolled at Learners Academy till the time they are enrolled as a student with Learners Academy.

8. Teachers and Tutors

8.1. All the teachers and tutors of Learners Academy come from a variety of academic backgrounds and are fully qualified.

8.2. Learners Academy reserves the right to change the teacher and tutor any time during the term.

9. Illness – Medical Attention

9.1. Parents and guardians agree to provide full details of any medical condition and medical history of the Student to Learners Academy and to provide written notice to Learners Academy of any medication being taken by the Student, and any allergies suffered by the Student.

9.2. In the event that the Student is involved in an accident, sustains any injury or becomes ill whilst under the supervision or in the care of Learners Academy:

  1. Learners Academy will attempt to advise the Student’s parents or guardians as soon as reasonably practicable, and will endeavour to obtain the consent of a parent or guardian prior to Learners Academy seeking urgent medical treatment for students and
  2. Parents and guardians hereby authorise Learners Academy to obtain any medical treatment for the Student as may be deemed necessary by Learners Academy or staff acting on behalf of Learners Academy. Each of the Student’s parents or guardians agree to fully pay all expenses incurred by Learners Academy or its officers, staff or agents as a result of any medical treatment obtained for or given to the Student and hereby indemnify and hold harmless Learners Academy and its officers, staff and agents for any expense, loss, damage or liability of any kind and nature whatsoever and however caused or occasioned as a result of authorising or providing or arranging for any such medical treatment.

9.3. Parents and guardians acknowledge that Learners Academy Pty Ltd has a 24-hour exclusion policy for children who are sick, and that my child/children will not attend the program if suffering from an infectious or communicable disease as identified by the Department of Health.

9.4. If any child is found to be ill during the course of the program, he/she will not be allowed to continue to participate in the program and parents will be contacted to pick-up the child immediately. NO REFUNDS will be given.

10. Supervision

10.1. Learners Academy will endeavour to provide reasonable care of the Student while he Student is under the care or supervision of Learners Academy. However, parents and guardians, acknowledge and agree that Learners Academy is not liable for any damage, accidents, injury, loss, expense or liability that may occur as a result of the Student undertaking classes or activities provide by Learners Academy whilst under Learners Academy supervision. They understand that all costs incurred as a result of any damage, injury, loss, expense or liability that may be caused to public and/or private property by the Student will be completely paid by them.

11. Conduct

11.1. Parents and guardians acknowledge and agree that the Student and each of the parents or guardians of the Student will:

  1. Use best endeavours to ensure that the Student meets the requirements of any course or courses of study in which the Student is enrolled from time to time;
  2. Not engage in any unacceptable, delinquent, unlawful or criminal behaviour;
  3. Not do anything to vitiate or void any insurance policies of Learners Academy;
  4. Use best endeavours to ensure that the Student attends all scheduled classes except where there is a legitimate reason for non-attendance which has been accepted by Learners Academy;
  5. Observe and comply with these terms and conditions and any rules and/or code of conduct published or advised by Learners Academy from time to time; and
  6. Use best endeavours to ensure that the Student is responsible for the Student’s own books, materials, computers, equipment, personal items and/or property, does not cause any damage to property of other students or of Learners Academy or its officers, staff or agents, and hereby releases, indemnifies and holds Learners Academy harmless from and against any and all liability, damage, injury, loss or expense to such items however caused.

12. Inappropriate Behaviour and Discipline

12.1. No misbehaviour of child, parents or guardian will be accepted. Parents and guardians fully understand that if their child continuously demonstrates inappropriate behaviour after guidance procedures have been followed, they will be notified and their child may be removed, suspended for a period to be determined or excluded permanently from the Service. NO REFUNDS will be given.

12.2. Learners Academy reserves the right to undertake or administer any lawful and necessary disciplinary action in relation to or involving the Student arising from any breach of these terms or failure to comply with applicable rules and/or codes of conduct, including without limitation, engaging in any unacceptable, delinquent, unlawful or criminal behaviour. Parents and guardians understand that the consequences of such conduct may include Learners Academy:

  1. seeking an interview with me and/or other parents or guardians of the Student to discuss troublesome or disruptive conduct, or behavioural problems;
  2. banning or excluding me or other parents or guardians of the Student from entering or being present in or at any premises or courses of Learners Academy in the event of me or other parents or guardians of the Student engaging in any unacceptable, delinquent, unlawful or criminal behaviour; disrupting any classes provided by Learners Academy; or disrupting the management or operation of Learners Academy’s business; and/or
  3. in extreme cases, suspending, expelling and/or excluding the Student from further classes and/or tuition.

13. Classes

13.1. Learners Academy reserves the right to cancel any or all classes at any time during the year. In the event of cancelled classes, any fees paid for the cancelled classes will be completely refunded. Parents and guardians understand that Learners Academy will not be made liable for any damages incurred as a result of cancelled classes.

13.2. Learners Academy reserve the right to change days and location of operation. If that happens we will contact parents by email, text message or phone call.

14. Property and Inside the Classroom

14.1. Laptops, Tablets and Robotic kits are the property of the management and is provided to students for the classroom use only.

14.2. Students must take care all of the devices including laptops, robotic kits etc. as any damage caused to devices by students must be borne by the parents.

14.3. While doing work in Logical Coders program, Students will work and train in groups, it is essential that students cooperate with other students and facilitate project-based learning. Any aggressive or inappropriate behaviour with fellow students or teachers will not be appreciated and will be reported to parents. Such recurring behaviour may lead to de-registration and parents will be called to collect the student, no refunds shall be offered in such case.

14.4. Parents and/or guardians must advise us in advance while registering if the child has any special needs or conditions that we should be aware of.

14.5. No food consumption or sharing of food is allowed during the class.

14.6. For yoga classes students should wear comfortable clothing like t-shirt, shorts, and tights (no skirts please). Strictly no food an hour before the session. Children must bring their own yoga mat, towel and a water bottle. Shoes and socks have to be removed before the class.

14.7. Risk assessments will be regularly reviewed and updated.

15. Limitation of Liability

15.1. Parents and guardians acknowledge and agree that Learners Academy do not give any guarantee of improved academic results or of any particular level of academic achievement of the Student arising from provision of the classes, tuition, services or materials provided by Learners Academy, and they acknowledge that any results obtained by the Student are dependent on factors not within the control of Learners Academy, including the application and ability of the Student, their diligence, the amount of study and/or homework done by the Student, the nature and content of tests or examinations. To the maximum extent permitted by law, Learners Academy do not give any warranty as to the nature, the characteristics, the suitability for their purpose or the quantity of any classes, tuition, services or materials provided by Learners Academy.

15.2. Learners Academy will not under any circumstances be liable for poor academic results, scholarship or selective school entrance exams results, or otherwise in the event that the Student does not receive a scholarship, receives a worse than anticipated academic report, or fails a test at school or other academic or educational institution.

15.3. Except as provided in these terms and to the extent permitted by law, all express and implied warranties, guarantees and conditions under statute or general law as to merchantability, description, quality, suitability or fitness of the classes, tuition, services or materials offered or provided by Learners Academy otherwise are expressly excluded.

15.4. Learners Academy will not be liable in contract, tort (including without limitation, negligence or breach of statutory duty) or otherwise in any way whatsoever to compensate the Student or their parents or guardians for:

  1. Any physical or financial injury, loss, damage, increased costs or expenses;
  2. Any loss of profit, revenue, business, contracts or anticipated savings;
  3. Any loss, damage or expense resulting from a claim by a third party; or
  4. Any special, indirect or consequential loss or damage of any nature whatsoever caused by any defect or delay or for any other reason whatsoever, arising out of the supply, provision or operation of the classes, tuition, services or materials provided or arising out of Learners Academy’s negligence or in any way whatsoever.

16. Force Majeure

16.1. Learners Academy will not be liable for any failure to perform, and will be relieved of, its obligations under these terms occasioned by force majeure including (but without limiting the generality of the foregoing) war, legislation, civil commotions, fire, flood, tempest, earthquake, riot, theft, crime, war, explosion, act of God, strike, lockout, sabotage, embargo, labour employment difficulties, teacher illness, accident, breakdown, restriction, prohibition or any action by any government or quasi-government authority, and any other causes outside the reasonable control of Learners Academy or their supplier.

17. Indemnity

17.1. The parents and/or guardians of the Student, for and on behalf of their children, heirs, executors, administrators and representatives, agree to release, indemnify and defend Learners Academy (“indemnify” meaning protect by reimbursement or payment), with respect to all claims, liabilities, losses, suits or expenses (including costs and reasonable legal fees), made or brought by anyone, including a co-participant, third party, the Student, parents or guardians of the Student, or any member of the Student’s family, arising out of any injury, damage, death or other loss in any way connected with the Student’s enrolment or participation in Learners Academy activities or use of Learners Academy services, equipment, tuition, facilities or materials, however caused.

18. Updates

18.1. Parents and guardians agree that Learners Academy Pty Ltd retains the right to update the fees, policies of all their services where they see fit.

18.2. Parents and guardians agree to all the conditions of the enrolment, and that all information provided is true and correct to their current knowledge.

18.3. Non-compliance of any of the above stated terms and conditions may result in cancellation of the enrolment.
